These conditions govern the supply of VTKFUL soot removers, spare parts, and accessories manufactured by VTKFUL di Salvatore Soprano (hereinafter the "Seller"). Placing an order or paying a deposit implies full and unconditional acceptance of this contract.
The sale is considered completed exclusively ex-works/workshop of the Seller.
Bank Transfer: Payment for the entire supply must be received by bank transfer before the goods are shipped.
Delivery Obligation: The Seller will not make any shipments and will not allow collection of the goods until the balance has been credited to its current account. Deferred payments or cash on delivery are not accepted unless otherwise agreed in writing.
Delivery Times: The times communicated are purely indicative. Any delays do not give rise to termination of the contract or compensation for damages.
VTKFUL operates exclusively as a supplier of the movable property.
Exclusion: Installation, assembly, water/electrical connection, and final testing are not included in the price and are not performed by the Seller.
Responsibility: The Customer is obliged to appoint qualified technicians (DM 37/08) for the installation. The Seller declines all responsibility for malfunctions resulting from incorrect installation, unsuitable flues, or failure to comply with local regulations.
Soot reduction is influenced by external variables (draught, fuel type, maintenance). The Seller does not guarantee the achievement of specific emission parameters required by third-party bodies (ARPA, Municipalities) if these are due to factors unrelated to the machine's construction.
The Seller is not liable under any circumstances for indirect damages, such as: loss of revenue, interruption of business, or commercial (machine downtime) or administrative fines imposed on the Customer. The Seller's maximum liability is limited exclusively to the value of the goods purchased.
The warranty (12 months for VAT-registered customers, 24 months for private individuals) covers only manufacturing defects of the components and is void in the event of failure to perform routine maintenance or unauthorized interventions.
Methods: The warranty exclusively provides for the free supply of the spare part found to be defective, upon return of the faulty part for inspection.
Exclusions: The exclusions from the warranty include labor costs for replacement, travel expenses, and shipping/logistics costs (return), which are entirely the responsibility of the customer.
Wear: The warranty does not cover components subject to normal wear (filters, gaskets) or damage caused by limescale.
Even if transport is organized by the Seller, the goods travel at the Customer's risk. Any damage must be reported to the courier immediately by writing the following on the delivery note: "Received subject to inspection due to damaged packaging.". In the absence of such a reservation, claims for damage during transport will not be accepted.
The Customer's personal data will be processed exclusively for the purposes of the Seller's obligation to provide the service. related to the execution of the contract and legal obligations, in accordance with EU Regulation 2016/679.
For any legal dispute, the exclusive competent court is that of the registered office of VTKFUL di Salvatore Soprano, COURT OF NAPLES NORTH.
Specific approval of unfair terms
Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have read and specifically approved the following clauses: Art. 2 (Advance payment and delivery obligation); Art. 3 (Exclusion of installation and liability); Art. 5 (Limitation of liability and machine downtime); Art. 6 (Forfeiture of warranty and costs borne by the customer); Art. 7 (Transport and reservation); Art. 9 (Jurisdiction).
